We offer this Website, including all information, tools and services available from this Website, to you conditioned upon your acceptance of all the terms, conditions, policies and notices stated here.
1. Types of Personal Information Collected
- We will ask you for certain kinds of personal information (“Personal Information”) to provide the services you request. This information includes:
- Email List – When you create an account with us, you will be given the option to be added to our mail list. Whether or not you select this option, your Personal Information will never be shared with or sold to third parties that you have not consented to. 4. Non-Personally Identifiable Information
- 4.1 Through your use of this Website, we may also collect certain non-personally identifiable information from you (“NPII”). NPII is not associated with you as an individual. It is measured anonymously and only in the aggregate.
- 4.3 We may also use “pixel tags” (sometimes called “web beacons” or “clear gifs”), which are tiny graphic images, on the Website. Pixel tags help us analyze Users’ online behavior and measure the effectiveness of the Website and our advertising and marketing. We may also use other analytical tools to evaluate site performance through the use of aggregated data, which contain no Personal Information. 5. Your Security
- 5.1 We strive to keep your Personal Information private and safe. We take commercially reasonable physical, electronic and administrative steps to maintain the security of Personal Information collected, including limiting the number of people who have physical access to database servers, as well as employing electronic security systems and password protections that guard against unauthorized access.
- 5.2 Unfortunately, despite our best efforts, the transmission of data over the Internet cannot be guaranteed to be 100% secure. While we will use every reasonable means to ensure the security of information you transmit through the Website, we cannot guarantee that such information will not be intercepted by third parties. 6. Privacy/Data Protection of Au Pair Personal Data
- In this section:
- Au Pair Personal Data means personal data relating to any au pairs (which in this section includes (1) au pairs/companions taking part in the Program, or (2) prospective au pairs/companions who wish to take part in the Program (whether before or after the date of this Agreement));
- Consent means the au pair’s agreement to the processing of personal data relating to him or her (through a statement or a clear positive action), which must be freely given, specific, informed and be an unambiguous indication of his or her wishes;
- Privacy Laws means the EU Data Protection Directive 95/46/EC, the General Data Protection Regulation (EU) 2016/679, and any other applicable law or regulation relating to the processing of personal data and to privacy (as amended or replaced from time to time);
- Personal data means any information identifying an individual or relating to an individual that allows him or her to be identified (directly or indirectly) from that data alone or in combination with other information;
- Personal data breach means any accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data; and
- Process or processing means any activity that involves the use of personal data, including obtaining, recording or holding the data, or amending, retrieving, using, erasing or destroying it, or transferring it to third parties.

- You agree to only process (or use) Au Pair Personal Data to the extent that is necessary for the following purposes:
- to select an au pair for you family;
- to engage and manage the au pair you select (if any);
- to comply with this Agreement and our requests from time to time; or
- to comply with a legal obligation (in which case you must notify us).
- You agree to only process (or use) Au Pair Personal Data:
- relating to prospective au pairs, until you have decided which particular au pair you would like to select for you family (if any), following which you shall promptly and securely delete all copies in your possession of the Au Pair Personal Data relating to au pairs you decide not to engage; and
- relating to any au pair who takes part in the Program as part of your family, until the end of their placement with you (unless you have obtained their Consent to do otherwise), at which time, you shall promptly and securely delete all copies of the Au Pair Personal Data in your possession and, if we so request, provide us with confirmation in writing that you have done so.
- You shall:
- treat Au Pair Personal Data confidentially (and ensure that other members of your household shall do the same);
- not store or transfer Au Pair Personal Data outside the U.S, except to us;
- not disclose Au Pair Personal Data to any person outside your household, or otherwise allow any such person to process Au Pair Personal Data, without our prior written consent;
- as far as possible, ensure that you have appropriate security measures (such as password protected laptops and email accounts) to protect Au Pair Personal Data against unauthorized or unlawful processing and accidental destruction, damage or loss, so as to enable us to comply with our obligations under the Privacy Laws;
- promptly provide any information or assistance reasonably required by us, to enable us to comply with our obligations under the Privacy Laws, including assisting us to:
- comply with our own security obligations;
- respond to requests from au pairs exercising their rights; and
- inform au pairs about serious personal data breaches; and
- keep any information that is necessary to demonstrate compliance with your obligations in this section, including full and accurate records relating to the processing of Au Pair Personal Data and shall, upon reasonable notice, provide copies to us or our representatives of any information or records kept by you under this term.
- If you become aware of any suspected or actual personal data breach relating to Au Pair Personal Data, you shall notify us within 24 hours, and provide any information that we may need to report such circumstances to the relevant supervisory authority and/or notify the affected au pair(s) (as we may decide).
- If you receive from any au pair:
- any communication asking to exercise their rights under the Privacy Laws; and/or
- any complaint or any claim for compensation arising from or relating to the processing of Au Pair Personal Data,
- you shall (1) notify us (within 4 days of receipt) and (2) provide us with any assistance we may need (within 7 days of our request) to comply with our obligations to respond to requests from such au pair under the Privacy Laws.
7. Links to Other Websites
- 7.1 While visiting the Website, you may link to websites operated by third parties or you may have come to the Website using a link found in another website. This does not mean that we endorse these websites or the goods or services they provide. We do not make any representations or warranties about any website that may be linked to the Website. Such other websites are independent from us, and we have no control over, or responsibility for, their information, products or activities.
- You will receive emails from us only if you have asked to receive them. If you do not want to receive e-mails from us you may click on the “unsubscribe” link at the bottom of any email communication sent by us. Please allow us 10 business days from when the request was received to complete the removal, as some of our promotions may already have been in process before you submitted your request.
